Terms of Service

These Terms of Service ("Terms") govern your access to and use of CutNest ("Service"), operated by CutNest ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

CutNest is a web-based nesting optimisation tool for laser cutting, plasma cutting, and CNC routing. It accepts DXF (and optionally DWG) files, arranges parts on sheets to minimise material waste, and exports results as DXF, SVG, PDF, and G-code files.

2. Accounts and Authentication

Access to certain features requires creating an account. We use passwordless, magic-link authentication: you provide an email address and we send a one-time sign-in link. You are responsible for keeping access to your email account secure. You must provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to probe, scan, or test the vulnerability of the Service or bypass any security measures.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated means to access the Service at a rate that unreasonably burdens our infrastructure.
  • Resell or sublicense access to the Service without our written permission.

4. Subscriptions and Payment

CutNest offers a free tier and paid Pro subscriptions (monthly, yearly, and 2-year). Payments are processed by Paddle, which acts as our Merchant of Record. By purchasing a subscription you agree to Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period. You can cancel at any time from the billing portal; cancellation takes effect at the end of your current paid period and you retain Pro access until then.

We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes do not apply until your next renewal.

5. Free Tier Limits

The free tier is limited to 3 nests per month and 20 parts per nest. We may adjust these limits with reasonable notice.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by CutNest and are protected by copyright and other intellectual property laws. Your uploaded files remain your property. We do not claim ownership of files you upload, and we do not use your files to train machine learning models or share them with third parties.

Uploaded files and nesting results are stored temporarily in-session (up to 24 hours) and are not permanently retained after your session expires.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your requirements.

Nesting results are optimisation suggestions only. You are responsible for verifying outputs before use on cutting equipment. CutNest is not liable for material waste, machine damage, or injury resulting from use of the Service's outputs.

9. Limitation of Liability

To the maximum extent permitted by law, CutNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms, with or without notice. On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use after the effective date of changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved in the courts of competent jurisdiction.
